AvailableMart respects the intellectual property rights of others and expects users of this site to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to valid notices of copyright infringement.
1. Filing a DMCA Takedown Notice
If you believe content on AvailableMart infringes your copyright, please send a written notice to our Designated Agent (below) that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material you claim is infringing, with enough detail for us to locate it (a URL is ideal)
- Your contact information — address, telephone number, and email address
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on their behalf
2. Designated Agent
Notices of claimed infringement should be sent to our Designated Agent at infoavailablemart@gmail.com with the subject line “DMCA Takedown Notice.”
Notices that do not follow this procedure may not receive a response.
3. Counter-Notification
If you believe content you posted was removed in error, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the material removed and its location before removal
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district
4. Repeat Infringer Policy
In appropriate circumstances, AvailableMart will disable or terminate access for users or contributors who are repeat infringers of intellectual property rights.
